Probate is the legal process of administering the estate of a deceased person. The process is often complex and includes resolving all claims against the deceased (paying off debts) and distributing the deceased´s property under a valid will to the correct beneficiaries. Additionally, you may need to prove the validity of the will to the court, identify and inventory the deceased´s property, and conduct a property appraisal. Think of the probate process as a guide that directs the orderly transfer of your estate according to the rules. Probate makes sure that your property is distributed the way you want and to who you want. Probate administration is a court-supervised process and may become very time consuming and expensive for you. The estate tax is a tax on the transfer of property to others, generally from a decedent to their loved ones. Often, the decedent´s estate may have to pay estate taxes (federal and state) before property may be transferred and distributed. The estate tax is based on the value of the decedent´s “gross estate,” which is the value of all the property the decedent has at the time of death. An estate tax form must be filed before distributing of the estate can take place.
