 Successful Chapter 7 Bankruptcies


Robert & Maria, Ontario
The Problem: Robert and Maria had racked up over $45,000 in credit card bills. Additionally, they had over $10,000 in unpaid medical bills. Robert had been in a car accident and was unable to work for over a year, so the bills kept racking up. They were current on their mortgage but with the unpaid bills growing, they wouldn’t be able to hold on any more. The final straw came when a they were sued over a credit card account that they owed over $10,000.

The Solution: Robert and Maria came to Atlantis Law Firm because they did not know what to do about the lawsuit. We filed an emergency bankruptcy case for them, which immediately stopped the lawsuit. We walked them through the process, prepared their case, filed it, and in 3 short months, their bankruptcy case was discharged. Robert and Maria had over $55,000 in debts wiped out. They have a new start and are working on re-building their credit, debt-free.  


Emily, Rancho Cucamonga
The Problem: Emily owed back taxes for 2008 and 2009. As a result, the IRS started garnishing her wages–she was getting over $500 taken out of each paycheck. She had just bought a car a few months ago, with an extremely high interest rate. Emily came to Atlantis Law wondering what she could do.

The Solution: Atlantis Law Firm filed a chapter 7 bankruptcy for Emily. This immediately stopped the wage garnishments. We took care of notifying the IRS immediately, and the very next paycheck, the garnishments stopped. Additionally, since her tax deficiencies were old enough, they were also discharged in the bankruptcy. Emily also had over $20,000 in credit card debts wiped away. Additionally, we negotiated with the company financing her car and were able to lower her interest rate by over half. Now, her monthly car payments are lower and more affordable.


Michael, Santa Ana
The Problem: Michael had a good paying job but had accumulated a lot of debt. He owned many assets- a valuable car, an IRA, some stocks, and a partial ownership interest in a start-up company.

The Solution: Michael had previously visited other bankruptcy attorneys who told him he did not qualify for a chapter 7 bankruptcy. However, with Atlantis Law Firm’s expertise, we were able get Michael to qualify for a chapter 7 by using deductions and more living expenses. We were also able to protect all of his assets- none were taken from him during his case.  Three and a half months after filing, Michael received his discharge, and his debts were gone.

John & Patricia, Riverside
The Problem: John and Patricia had come on some hard times. They owned their own business so their income was up and down each month. They had fallen behind 6 months on their mortgage payments and their home was being put for a sale in a month. The house was over $150,000 upside down, and they had a second mortgage on the home as well. They also owed some back taxes from 2010.

The Solution: Atlantis Law filed a chapter 13 bankruptcy case for John and Patricia. The filing stopped the upcoming trustee’s sale of their home and put it on hold for the duration of their case. We prepared a feasible chapter 13 Plan for John and Patricia, a monthly payment they could afford. Their house arrears were put into the plan to be paid off so they could keep their home. We filed a Lien Avoidance Motion for them and successfully got it granted. This meant that their second mortgage would be completely stripped and they would not have to pay on it anymore. Additionally, the back taxes they owed were also put into the plan. After 5 years, John and Patricia will have completed a chapter 13 case, received a discharge, kept their home, and come out debt free.
