3 Things to Look For When Choosing a Bankruptcy Lawyer

There are plenty of bankruptcy law firms out there, how do you choose? The list below are things to consider when choosing a bankruptcy lawyer.

  1. The first question you need to ask is, “Are you a bankruptcy lawyer?” This may seem like common sense, but the reality is that many bankruptcy law firms have paralegals or “specialists” conduct the initial consultation. The so-called “specialist” is nothing more than a salesman trying to convince you to sign up with the firm. Does this “specialist” have a Bachelor’s degree? Does this “specialist” have a law degree? Did this “specialist” pass the grueling 3-day bar examination to become licensed to practice law in California? If you’re going to a law firm, don’t you expect to meet with a lawyer? When you make the appointment, make sure that you’ll be meeting with a lawyer and not some “specialist”. Bankruptcy is a legal process, and you shouldn’t be taking any legal advice from someone who is not licensed to practice law.
  2. Who will be handling your case? Many law firms out there are nothing more than factories pushing out tons and tons of bankruptcy paperwork completed by non lawyerss. Make sure you ask, “Who will be handling my paperwork?” If it’s not a lawyer, then why would you go to a law firm and pay law firm prices?
  3. What does the price include? Many firms advertise a super low price to get you in the door, then hit you with hidden fees when you get there. Make sure you know what you’re getting for the price. Some firms will only fill out the paperwork and make you drive all the way to the courthouse and file the paperwork yourself and won’t even come with you to court. Do you want the Wal-Mart of law firms cutting corners left and right in order to give you a “good deal,” when it comes down to something as important as getting your finances back on track?

Most importantly, it really boils down to trust. Do you trust the lawyer? Did the lawyer answer all of your questions? Did the lawyer take the time to explain the process to you? Is the lawyer trying to sell you or help you? At the end of the day, you need to be able to trust your lawyer and trust that he will do a good job on your case.
